――現行法をどのように評価していますか。
「著しく国際標準から逸脱している。12年間で81件の提供にとどまっており、『臓器移植禁止法』と言われてもやむを得ない面がある」
――具体的にはどこが問題なのでしょうか。
「ドナーカードを持って、臓器提供を明確に考えている人だけを対象にしており、なかなか臓器提供に結びつかない。また、15歳未満の子どもは、世界保健機関（WHO）のルール変更で渡航移植もできなくなる（見通し）。日本人の命をきちんと救うようにしておくことが大事だ」
――なぜA案での改正が望ましいのでしょうか。
「脳死は人の死という原則を明確にしている」
――ただ、脳死を人の死と割り切れない人も多い。
「心臓が動いていて体が温かいのに死んでいるとは思えない人は、法的脳死判定を拒否することができる。A案は、何人も『嫌だ』ということを強制されず、すべての人の意思を尊重できる」
――虐待された子どもが、虐待した親の同意で臓器を摘出される懸念があります。
「A案では虐待が疑われる場合は提供できないことになっている。（それを防ぐ制度設計は）臓器移植の問題ではない。仮に虐待の人が紛れ込んでいたとしても、脳死で死んでいることは間違いない。臓器提供後でも司法解剖はでき、デメリットを受ける人はいないのではないか」
――子ども脳死臨調を開き、議論のインフラを整えるべきだという考え方がある。
「脳死については81件の臓器提供もやっていて必要ない。小児の脳死は医の話だ」
――審議で何を明らかにすべきか。
「臓器提供の現状と、どれだけの方が待っておられるのか、きちんと議論して欲しい。A案支持が大多数だと思うが、これまで反対派が審議拒否してきた。完全に国会の不作為だ」（南彰）
■現行の臓器移植法と各改正案
臓器提供の条件 子どもからの臓器提供
現行法 家族の拒否がなければ提供可 15歳未満は不可
A案 本人に拒否の意思がなく、家族が同意 0歳から可能
B案 現行法と同じ 12歳以上に限定
C案 現行法と同じ 現行法と同じ（今後の検討事項）
D案 15歳以上は現行法と同じ。 0歳から可能
15歳未満は家族の同意と第三者機関の確認が必要
