「家族の同意だけで臓器提供可能」 改正法案、与党調整へ

008212005年02月15日夕刊2総合00200427文字 脳死状態になった場合、家族の同意だけでも臓器提供を可能とする臓器移植法の改正案について、自民党の「脳死・生命倫理及び臓器移植調査会」（佐藤泰三会長）は15日、今国会提出に向けて与党内で調整する方針を確認した。自民の有志が公明側と話し合い、3月中旬の提出をめざす。
改正案は04年2月に同調査会がまとめた。（1）本人の意思が不明な場合、家族の同意だけでも脳死判定・臓器摘出を可能とする（2）配偶者や2親等以内の親族に限り提供先を指定できる、などを盛り込んでいる。本人意思を前提とする現行法の原則を緩和し、事前に態度を決めていなかった人からの臓器提供を可能にすることで、提供数を増やすことが主目的。家族の承諾で、15歳未満からの臓器提供にも道を開くことになる。
ただ、自民内にも「刑法上、脳死をどう扱うのか」など、脳死を人の死とすることへの根本的な問いや、乳幼児の脳死判定、被虐待児への対応などを危惧（きぐ）する声もあり、与党内での調整に課題を残している。
