（臓器移植インタビュー）脳死、厳密な定義必要 C案を提案・阿部知子氏

――現行法をどのように評価していますか。
「脳死が人の死であるか否かの判断は国民に委ね、臓器の摘出には書面による本人同意を求める形に落ち着けた。国内での臓器移植の基盤整備をするときに国会がとった英知だと思う」
――臓器の提供数が増えないとの指摘があります。
「本人同意の要件をなくせば増えるという主張があるが誤りだ。提供する側が納得して出せるようにしないと、移植は増えない」
――なぜC案での改正を主張されるのか。
「『臓器移植制限法案』みたいに言われるが、施行から12年たち、長期の脳死生存例が知られるようになった。『脳死と言われ、医者はもう見放している』と治療の早期打ち切りを懸念する声も寄せられている。脳死の定義をもう一度確認し、厳密化しないといけない。また、ガイドラインに委ねられている生体移植も含めて、全部法律でルール化する」
――国内でも子どもの臓器提供を解禁すべきだとの声が出ていますが。
「小児科学会でも結論が出ていない。子どもの臓器提供はあくまで親の代諾になるので、これを支える仕組みを論議する子ども脳死臨調をやるべきだ」
「『移植が必要』と言われる子どもを減らすことの方が本質的に大事だ。日本は特に1～4歳の急性期の小児医療が貧弱。拡張型心筋症になる前に治療介入するなど、本当のよりよい治療をすれば、移植を求める子どもの数は大幅に減ると思う」
――今国会で改正案の採決を求める声が強まっている。どのような点の審議が必要でしょうか。
「救急医療体制も含めた問題点を明らかにして、国民の選択が反映できるような法体系を考えていくべきだ。死は国会議員の専権事項ではなく、解散総選挙の行きがけの駄賃みたいにやるべきではない」（南彰）
