臓器移植法、参院へ独自案民主・社民有志議員ら「子ども脳死臨調」盛る

004272009年06月20日朝刊2社会03800642文字「脳死は人の死」を前提にした臓器移植法改正のA案が衆院で可決されたことを受け、参院の民主、社民両党などの有志議員は19日、週明けに「子ども脳死臨調」の設置を求める独自案を提出する方針を固めた。来週から参院でA案と一緒に審議される予定。
A案では、「脳死は人の死」とみなすことで提供者の生前同意を必須条件から外し、家族の同意があれば0歳から臓器提供できる。しかし、子どもの脳は回復力が強く、小児の脳死判定基準は専門家の間でもなお議論がある。親の虐待で脳死状態になる子どももおり、A案は移植を望む患者団体が支持しているが大幅な要件の緩和には批判もある。
こうした声を踏まえ、独自案では、衆参両院の同意を得て、首相が任命した15人以内の有識者で構成する脳死臨調を設置することを盛り込む。
（1）子どもの脳死判定基準（2）子どもの自己決定や親の関与が認められる範囲（3）虐待を受けた子どもからの臓器摘出を防ぐ仕組みなどを検討する。
世界保健機関（WHO）が来年の総会で渡航移植の規制を目指した指針改定をする見通しで、子どもの渡航移植は難しくなっており、施行後、1年以内の答申を求める。
提出者の森ゆうこ議員（民主）らは当初、判定基準を厳格化するC案を基に独自案の提出を検討していた。しかし、C案は移植学会などの批判があり、脳死臨調の検討に委ねることにした。
参院には、脳死を人の死とは認めない宗教団体などと関係が深く、移植を推進するA案に抵抗感のある議員も多いとされる。
