臓器移植法、改正案採決へ動き 与党合意、なお曲折も

006272007年04月25日朝刊政治00400730 自民党の二階俊博、公明党の漆原良夫の両国会対策委員長は24日、国会内で会談し、議員提案されたままになっている2本の臓器移植法改正案について、今国会で採決することで合意した。衆院厚生労働委員会の下に、両案を集中的に審議する小委員会を設置。意見集約を図ったうえで、党議拘束を外して採決するとしている。
ただ、隔たりが大きい両案について、与党内でも議論が尽くされたとは言えず、民主党からも突然の方針に反発が出ている。実際に採決できるかは不透明だ。
2本の改正案は06年3月に提出されたが、実質的な審議に入れない状態が続いている。昨年12月、衆院厚生労働委員会で参考人質疑が行われたが、心臓移植を待つ患者や家族、移植医らは早期の改正を求めて要望を続けていた。こうした情勢を踏まえて、二階、漆原両氏は「人の生命にかかわる法案であり、いつまでもたなざらしにはできない」として、今国会で採決すべきだとの考えで一致した。
現行法は臓器移植をする場合に限り、脳死を人の死と認める。臓器提供者は15歳以上とされているが、これに対する改正案は、（1）脳死を一律に人の死とし、15歳未満の臓器提供や本人の拒否がない場合の家族同意による臓器提供を認める（2）現行法の枠組みを維持し、意思表示を認める年齢を現行の15歳以上から12歳以上に引き下げる――の2案が提出されている。
衆院厚生労働委員会はこれから社会保険庁改革関連法案の審議に入る。その先には雇用関連法案の審議も控える。
このため、委員会の自民党議員からも「いくら小委員会を設けても、この日程では難しい」との声が出ているほか、民主党理事は「国論を二分する問題であり、1週間程度審議して採決するような話ではない」と反発している。
